Elderly neighbour's death 'complex'

A scuffle that ended with the death of a 78-year-old man is a "complex" matter, the High Court has heard. 

Emanu Toafiga, 62, is charged with the manslaughter of his 78-year-old neighbour Leslie Otto.

He allegedly bashed the pensioner in April after Otto attacked him.

Defence lawyer Steve Cullen said it was case of Otto creeping up behind Toafiga and attacking him with a crow bar.

The two men both lived in a block of units in Waterview.

During the scuffle, Otto hit his head on the ground.

Cullen said Otto developed pneumonia in hospital and was seen pulling his tubes out.

He died three weeks later.

Cullen asked for an adjournment while the complex issue of "causation" was investigated.

Justice Pamela Andrews agreed and adjourned the case for four weeks.

Neighbours described Otto as a quiet man who had lived at the property for about a decade.
