Kim Kardashian and her sisters have scored a legal victory against their ex-stepmother.

Kim, Kourtney and Khloé Kardashian, as well as their mother, Kris Jenner, were named in a suit filed by Ellen Kardashian last year after the women slammed Ellen for making sensational claims about the family to a tabloid.

Ellen, who had married the girls' father, Robert, shortly before his death, accused the Kardashians of intentional infliction of emotional distress, civil conspiracy to defame and public disclosure.

But RadarOnline reports Los Angeles Superior Court Judge Mitchell L Beckloff issued a preliminary ruling on Monday in the reality TV stars' favour, indicating he would be dismissing the counts.

Ellen also claimed libel and defamation, however, which the judge indicated he would allow.

Radar previously reported Ellen's legal team had asked the judge to deny the Kardashians' attempt to dismiss the trial, citing free speech.

"Even based upon the limited discovery thus far, Plaintiff can demonstrate a substantial likelihood that defendants made their statements with actual malice in regards to the truth," legal documents obtained by the website state.

"The manner of the statements in this case are clearly exaggerated, overdrawn and colored to the detriment of Plaintiff."

A formal ruling is expected in the next few days.

Ellen Kardashian last year reportedly went to InTouch magazine with Robert Kardashian's private diaries, composed between 1989 and 1990.

She claimed Robert detailed in them how Kris cheated on him during their marriage, left their children unattended and physically abused Kim.

The family has denied the claims.

Robert Kardashian was married to Kris Jenner from 1978 to 1990. The couple had four children, Kim, Khloe, Kourtney and Robert.

Robert then married Ellen, his girlfriend of six years, two months before he died of oesophageal cancer in 2003 at the age of 59.

Kris went on to marry husband Bruce Jenner in 1991. The couple share two teenage daughters, Kendall and Kylie.

Kris and her children with Robert are asking for $500,000 in a separate suit against Ellen, claiming she sold their property, including family photos and writings, to a media outlet in January 2013.
