NOTHING FLASHY: Pornographer Steve Crow wants the High Court to stop the Auckland City Council from passing a by-law outlawing the Boobs on Bikes parade.

Boobs on Bike is heading back to the courts even if the Auckland City Council (ACC) wants to back out, pornographer Steve Crow says.

He told Stuff.co.nz he wants the High Court to stop the council from passing a by-law outlawing his kind of parades.

Each year he holds the parade to promote his Sexpo shows, attracting about 50,000 people into the city.

Last year, ACC went to court in a bid to halt the parade, but District Court Judge Nicola Mathers said it could go ahead even if it was tacky. She said it was not unlawful for females to walk down the street topless.

The council began a High Court bid to get that decision overturned but the council's city development committee is likely to end that action on Thursday.

A working party on the bylaw, headed by councillor Graeme Mulholland, has instead recommended that the council write to Prime Minister John Key "to put council's case and seek a legislative change to enable the council to regulate events that are not deemed suitable to the public domain".

Mr Mulholland said all but one councillor voted to ban the parade last year.

Mr Crow said he was surprised the council continued to waste council time and rate-payers money attempting to introduce a bylaw that clearly seeks to breach the Bill of Rights.

It is very great concern that they wish to introduce the word "subjective" into the bylaw.       

He said he was talking with his lawyer with the intent to seek a judicial review via the High Court of the bylaw and the process by which the council introduces bylaws.

"We believe the bylaw is unlawful. Whatever the council does will have no effect on me whatsoever; I will not comply with any law that breaches my rights as guaranteed by the Bill of Rights," Mr Crow.

Boobs on Bikes(aptly named in more sense than one) is not a cultural event. It is merely advertising Mr Crows money making enterprises. No public funding or publically funded services should be used to assist such ventures. Any its like looking at replica jewellry - its all fake. Maybe rename it "silicones on cycles".

Here's a question for you - which christian franchise do you belong to?

I ask because you've taken the concept of top free women and turned into public sexual intercourse. That's not what is being proposed, it may be what you secretly desire but it's not what is going to be done. Your strawman argument is a classic technique used extensively by those promoting christian viewpoints but it's completely transparent and holds no water upon proper inspection.

I don't have kids yet, but when I do I'll raise them how I was raised - with an open mind. There is nothing to fear about the human body, nor is there anything to be ashamed of. Breasts are just that, breasts. People choose to sexualize them all they want to but that's their choice to make.

Do you take also issue with mothers breast feeding in public? How much more do you want to repress women?

You don't have to go to the parade, but you probably will just like all those people who complained to companies who advertized during Californication watched the show to get that information. Why does your ilk feel the need to impede the activites of others that has no direct effect on yourself?

What makes me sad is I actually support Mr Crow's stance against the council. Why the hell would the council seek a high court ruling basically giving them determination on public propriety? If successful, this then opens the gate for all councils to seek the same thing resulting in different standards all over the country & likely corruption. I think Mr Crow is a bottom-feeder, profiting off the embattled members of society in a brazen way. But, no one can challenge his intelligence & ability to get the job done. People used to say the same negative things about Hugh Hefner & Larry Flynt and yet they dominate headlines & are wealthy as. Like any other vice, porn needs moderation, sadly, the ridiculous BoB is nothing more than a blemished foot note considering the many other forms of culture on display in our country. Certainly nothing to get your "tits tied" over. Rangi.

@ 12 Ummmm Glenn, Your post had me in stitches, firstly I am a choreographer for erotic dancing, so calling me a prude, was so off base it isn't funny, but you weren't to know that, so that's ok!

Actually 50,000 as you put it, was just a lie, so if you address me again, can you please provide facts. Most people AREN"T interested, and that is a fact, Steve Crow doesn't exactly recruit beauties, and the parade itself is actually very tacky, I am NOT against it though, I am against all the publicity Steve Crow gets by these silly councilors who should have better things to do!

Post again if you want, but please read properly first, because i can sniff out someone with a valid opinion, and can also sniff out the silly man who gets excited about his 'boobs on bikes' one day a year. Liberated people are classy, they don't stand around on a street looking at b grade soft topless porn.

Some questions please? How many of you making thise liberal comments have children? Would you be happy for Crow to have full nudity or sexual intercourse on his parade? How many would be happy to have their daughters working for Crow and exposing themselves on the street? Why did Wellington City Council assist Crow by blocking the streets, putting dozens of Police on the streets to assist, and giving Crow access to Post Office Square to organise his parade? PS Wellington City Council (without consulting anyone) has recently made every beach a nude beach - whats the real agenda Kerry?

yeah it's bad. freedom of expression as a historical concept is about contributing to public discourse, to politics and stuff like that. in this case it's being used to promote consumerism. i personally hate it, but the "it's just a bit of fun" or "just ignore it" people, i disagree with them but they have a point. but the crow guy, to talk about freedom of expression like that, wow. is this what the west has come to? the whole heritage is cheapened cos it's used to justify total self-centredness... it used to be about building communities.. ra ra.

The heart of the matter is voters, not a panel of unelected judges, should define human freedoms. These instruments (Bill of Rights)undercut citizens' participation in social decision-making. They transfer too much power to unelected judges. This is why Crow wants to go to court. Let the people decide!

The bylaw is indeed illegal. It infringes on the Bill Of Rights because it is unlawful for any government to discriminate against freedom of speach and or peoples sexuality.

What concerns me is that if the council can do this, then what will stop them them from stopping people have political rallys.

Would they treat mardigras in the same way. They were televised.
