Cafe owner 'breached 'human rights' kicking out Israelis

An Invercargill cafe owner's refusal to serve Israelis on the basis of their nationality is a clear human rights breach, Race Relations Commissioner Joris de Bres says.

Sisters Natalie Bennie and Tamara Shefa were upset after being booted out of the Mevlana Cafe in Esk St yesterday by owner Mustafa Tekinkaya.

They chose to eat at Mevlana Cafe because it had a play area for Mrs Bennie's two children, but they were told to leave before they had ordered any food, Mrs Bennie said.

"He heard us speaking Hebrew and he asked us where we were from. I said Israel and he said 'get out, I am not serving you'. It was shocking."

Mr Tekinkaya, who is Muslim and from Turkey, said he was making his own protest against Israel because it was killing innocent babies and women in the Gaza Strip.

"I have decided as a protest not to serve Israelis until the war stops."

He said he had nothing against Israeli people but if any more came into his shop they would also be told to leave, and he was not concerned if he lost business.

Mr de Bres said the Human Rights Act prohibited discrimination in the provision of goods and services on the grounds of ethnic or national origin, or of political opinion.

"Whatever the rights and wrongs of the situation in Palestine, it is simply against the law for providers of goods and services in New Zealand to discriminate in this way," he said.

Mr Tekinkaya's stance was supported by neighbouring Turkish Kebabs shop owner Ali Uzun, who said he was also refusing to serve Israelis.

Mrs Bennie said she did not disagree that Israel was committing crimes against children.

"I just don't think I should be declined service because I am from Israel."

She had rung the Human Rights Commission and was told the cafe owner's actions were against the law because he was discriminating on the basis of ethnicity.

"I wouldn't mind having a chat to him. Someone has to put him in his place," Mrs Bennie said.

Ms Shefa is visiting Mrs Bennie at her Makarewa home, on the outskirts of Invercargill, where she lives with her New Zealand husband and two children.

Both women said they had travelled widely, and to places much more hostile than New Zealand, but had never been treated in such a way.

Invercargill Mayor Tim Shadbolt was shocked when told of the incident.

"Oh my god, the Gaza Strip has come to Invercargill. Hell's bells."

He said he was bewildered.

"Generally speaking I am against all wars and I suppose people have got a right to protest. I couldn't really deny that. It would have been upsetting for the women and I feel sympathy for them."

Exactly! This is not a way to protest.

Imagine if we had instead been reading about how an he had welcomed an Israeli into his cafe with extra hospitality... showing that he cares beyond all the hate and anger.

A little bit of kindness, caring and love is such a situation goes a very long way. In the end we all want to live peacefully and happily. We here in NZ can set the example.

I see this is a wasted opportunity that can now only fuel the issue more...

This is terrible, play areas for children in a cafe! They should be discouraged, not encouraged to take their rug rats into cafes. Do they double park outside the cafe for practice when the kids are ready for school as well? I will be not going to this cafe untill the play area is removed! But being from Akld, i dont think this going to have much of a impact:)

I think this is a strange situation. Firstly, he isn't from Palistine! He can't say it's an attach on Muslims and thats why he's defending it as there are attacks from many nations on Muslims all over the world and they get served! I would of agreed with him he said he didn't agree with the situation going on there and he was taking a stand. Why not? he stands to loose or gain business.

I am all for protesting when the circumstances are appropriate. However this just seems plain wrong to me. This was in Invercargill, New Zealand where a Mother had taken her children to a restuarant to eat. She is not to blame for the genocide, she lives in Invercargill and because of where she was brought up she is being turned away from a restuarant. This is racial discrimination and should not be tolerated by any New Zealander!! Do not encourage this.

I am completely shocked that so many people are, in effect, supporting Hamas. Check out point 7b of their charter:

"The Day of Judgement will not come about until Muslims fight the Jews (killing the Jews), when the Jew will hide behind stones and trees. The stones and trees will say O Muslims, O Abdulla, there is a Jew behind me, come and kill him. Only the Gharkad tree, would not do that because it is one of the trees of the Jews." This is the kind of people Israel are trying to defend themselves against.

It's a protest, and the owner has a human right to do so under democractic, political, social, and economic rights. It is not a Human Rights issue because Israelis are not picked on as individuals, but because of a well known cause.

That's the consequence Israel or USA has to think of before unilaterally bombarding any nations and knowing the full risk to innocent civilians including women, elderly, and the children.

So there, don't take it out of context, and show your one sided blindness to Israelis atrocious action...
