A man is on trial jointly charged with causing injury by carelessly using a paintball gun.

The jury trial for Travis Colin Kemp, 29, started yesterday in the Invercargill District Court.

He faces two joint charges of unlawfully possessing a paintball gun and using it carelessly causing bodily injury.

Kemp has pleaded not guilty.

Crown lawyer Mike Mika, in his opening address, told the jury Kemp was driving a car with Brendon Edward Murray Campbell in the back seat on the evening of August 30.

Campbell had since pleaded guilty.

The Crown alleges that while Kemp was driving, Campbell fired pellets from a paintball gun at an oncoming car.

Kemp then did a U-turn and followed the car before speeding past it, when Campbell fired at the car again. Kemp pulled over and Campbell fired again as it went past, Mika said.

While Kemp was following the car, his lights were on high beam, he said.

One of the paintball pellets went through the open window and struck the complainant on the arm, causing bruising, he said.

The car was also damaged.

Defence lawyer Simon Claver told the jury the case was all about what happened and which version of events the jury found more probable.

He urged the jury to listen carefully to each witness, watch their demeanour and response to cross-examination.

The trial, before Judge David Saunders, continues today.
