The man whose revenge attack left Kapiti Coast man Robert Bryden "catastrophically" injured has lost his last chance to overturn the nine-year jail term he received.

The Supreme Court has said it will not hear the appeal of Ioritana Tuau, 23.

Tuau was punched by Bryden in Courtenay Pl in central Wellington on September 14, 2011, in an unprovoked assault.

Two strangers helped Tuau up and together they ran after Bryden, and assaulted him.

The other two people have not been identified and it was not clear what role they had in the assault. But a witness said Tuau had been kicking Bryden in the head, bracing himself against a railing to put more force into the kicks.

Tuau pleaded guilty to wounding Bryden with intent to cause grievous bodily harm and has to serve half the nine years' jail term before he can be considered for parole.

Tuau's appeal to the Court of Appeal was dismissed last year. He asked the Supreme Court to hear an appeal but in its decision the court there was no question of public or general importance in the proposed appeal. The court said it saw no appearance of a miscarriage of justice.

Courts have previously heard that Bryden needs round-the-clock care and has no short-term memory.
