The jury in the trial of a man accused of murdering Auckland Grammar School pupil Augustine Borrell retired this afternoon to consider its verdict.

Haiden Mark Davis, 20, has pleaded not guilty in the High Court at Auckland to murdering Mr Borrell on September 8, 2007.

The student was fatally stabbed during an altercation outside a service station in Herne Bay.

The prosecution argued the stabbing was deliberate and Davis was guilty of murder while the defence said it was unintentional and a proper verdict was manslaughter.

The jurors, who retired at just after 1pm, returned at 4.40pm to say they were unable to reach a verdict but Justice Rhys Harrison sent them back to continue their deliberations.
