A legal argument to hear oral evidence against the man accused of murdering Shane Braddick will be heard in the Timaru District Court tomorrow.
Braddick, 28, was found dead on York St about 3.15am on May 11.
St John ambulance service was called to the street after reports of a person lying on the road.
Timaru man Johnny Grant Holman, 25, has been charged with Braddick's murder but has not yet entered a plea, the district court registrar confirmed.
Through his counsel, Holman has asked to hear the oral evidence against him. The court fixture will determine if the oral evidence can be heard.
The result of the hearing will determine the next stage of the committal process and whether or not the matter continues to trial, the charges are altered, or the defendant pleads guilty.
He first appeared on Saturday, May 12, in front of a Justice of the Peace and did not enter a plea. He was in court again two days later. Holman again did not enter a plea and was remanded in custody.
