The mother of an 11-year-old girl who was indecently assaulted by a 76-year-old man is furious he has been allowed to serve his sentence opposite a Hamilton primary school.

The man, who was granted permanent name suppression when sentenced in the Hamilton District Court in December, was sentenced to nine months' supervision and ordered to pay reparation and costs totalling $1826.50 to the victim.

The man admitted a charge of doing an indecent act upon a girl aged under 12 years of age.

The victim's mother says she remains concerned as the offender still lives in the same house where the offending took place - opposite a primary school.

She said both she and the victim's younger brother had walked past his house and seen him sitting, looking out the window and waving at the children as they walked by.

The man lived next to a busy thoroughfare used by the children, she said.

"I'm just worried he will do it again, especially as my son is now going to the same school."

Her daughter, the victim of offending, is now aged 13 and attending a Hamilton high school.

However, she still struggled with what happened.

The woman is hoping authorities have their eye on the man as he serves his sentence - and beyond.

The school's principal did not want to comment specifically on the case, but said pupils were "well versed in stranger danger".
