John Banks' appeal will be heard in Wellington in October.

Banks, the ex-Epsom MP, ex-ACT Party leader, and ex-mayor of Auckland, was sentenced to two months of community detention after being found guilty of knowingly filing a false electoral return following his failed 2010 bid for the Auckland mayoralty.

He vowed to appeal saying "fresh evidence" had arisen since the conviction that would exonerate him. 

The Court of Appeal confirmed today that Banks' hearing would take place in Wellington on October 29.

Court documents from Banks' sentencing said the appeal would include evidence from witnesses at the lunch at internet mogul Kim Dotcom's house where the donations were solicited.

Dotcom and members of his staff testified that Banks asked for a donation of $50,000, to be split into two cheques so it could be kept anonymous.

Banks testified that no such conversation took place.

Throughout his trial, Banks maintained there were several American businessmen at the lunch at the Dotcom mansion where a donation was discussed.

They were not named, however, and were not called to give evidence at the trial.
