Colac Bay Visions Ltd has appealed to the Environment Court after the Southland District Council declined part of its proposed subdivision.
Of 10 lots, the commissioner declined two amid concerns about their effects on the landscape in a coastal resource area.
A Southland District Council spokesman said no court date had been set and the Environment Court had ordered the applicant and the council to try to resolve issues.
