Immigration grants reprieve for Brazilian couple ... with a catch

A Brazilian couple living in Queenstown say the reprieve of a six-month work permit goes against Immigration New Zealand's own policy, and raises more questions than it gives answers.
Marcio Tulio de Moura received the permit from Immigration New Zealand's Queenstown branch on Monday.
The work permit comes with the stipulation that Mr Moura leave New Zealand by late February next year.
New temporary work visas the couple applied for in June were held up when a medical examination showed his wife Barbara Ohana de Sena Vieira was pregnant, breaking the health requirements for a work permit.
This left the couple, who have been in Queenstown for over three years, with dwindling money and no income for 10 weeks.
While Mr Moura will now be able to return to work as a stonemason, Ms Vieira had a job offer from her previous employer at a Queenstown supermarket withdrawn.
The couple wants to stay in New Zealand to raise their growing family, including daughter Ana, 4.
"It doesn't make sense," Ms Vieira said.
"Their policy says people without residency should not have babies here, but they are giving me enough time to have my baby in New Zealand, then kicking us out."
The couple did not want to impose upon New Zealand taxpayers, but felt Immigration New Zealand had left them with no clear way to plan ahead.
"We can either pay $5000 for residency, but have friends who have found it difficult after having a baby – or leave just after the baby is born – which would still have an effect on the taxpayer," Ms Vieira said.
The letter from Immigration New Zealand Queenstown branch manager Louise Stewart granting the work permit stated the decision was "an exception to policy", but warned Mr Moura he should have "no expectation of a future exception to policy".
Immigration New Zealand spokesman Steve Jones yesterday said there would be no further comment on the matter from the department.

As Brazilian I can’t accept the ways Mr. Moura and his partner are using to get work visa here in this wonderful country. To get his partner pregnant, and to say that she will have an abortion, because an immigration officer’s advise. Is too much appellative, to put it on newspaper only for to get the public opinion in their favor and push to the immigration office here at Qtwn to give then the visa to stay here. He also says at in a topic at Orkut.com that, he hates NZ and the Brazilian, who are against his way to get a visa. On the same topic he also says Nz is a country for to pay taxes for kiwis only. For Mr. Moura schools and hospital here are horrible also. For him Brazilians who live here came from slums, are not educated and work in sub graduated jobs. He is offending all immigrants who chose to live and raise their kids here. The other point that I am angry with all that is, after he got his visa he came back to the topic and offended Brazilians telling the immigration office recognized the bullshit they did and finally granted his visa. He affirm that, he receives $25 to $35/ hour, and he is struggling for survive without work for 10 weeks, and he is posing with a BMW? For to finish in my opinion he is a shame for all Brazilians who work, live and raise their kids in NZ. GO HOME Mr. Moura.
According to Ms Vieira, NZ is worse than any other communist country she's ever heard of and Mr Moura thinks migrants make up most of the population of the southern region? lol Yikes! don't get us mixed up with Auckland - that's where all the riff raff are.
All I can say is please don't outright and blatantly insult or slander an entire nation and the people for it's immigration rules and regs, it's not each and every New Zealander's fault. It's NATIONAL's fault. I certainly hope those who voted for them are happy however while the rest of us in the real world who work hard have to work even harder to keep our dignity and jobs since National won't support unions.
But I digress, Ms Vieira & Mr Moura - apply for citizenship by all means.
Helen, you are sooo right, the amount of media coverage that this couple have had is just incrediable and as you say, they are still not happy... Rules are rules, you can not have a baby here and now Mike is trying to imply that they have been pressured to "kill their unborn child". Come on Mike, pull your head out of your butt, if she did not get pregnant in the first place then this would not be an issue. It is all about choices and that was the choice that they made.. Do we need to have a lesson in the basics of what causes pregnancy! In this day and age, there are so many precautions out there to have prevented this situation. They have brought it on themselves as far as I am concerned. Even other brazillian people think that it is just all for media attention.. It all boils down to the fact that if you don't like the way things are here then go home.. Don't keep whinging about it, running us down, just pack up and go home. I think we here in Queenstown would be better off without moaning people like you.. Either way, best of luck and have a safe trip home in February!!
Dear Mike Unfortunately these people are not deserving, rules exist and should be respected. This is not correct! If you doesn't like New Zealand, why to continue living here??? Mr. Vieira did not post all that he really thinks about this country. I will publish in the newspaper what I saw on a site called Orkut, widely used by Brazilians as the TV will also discuss the matter. And is really unfortunate to know that people like to sensationalize and more unfortunate still know that the Immigration spend time with people like these. And pity also know that this pregnancy is being used to generate controversy!If immigration approve the visa of all pregnant women without residence, this land would become a chaos! I am Brazilian and I know that so many want to take advantage and do not act with honesty and ethics!
I couldn't agree more with John I am also a member of the same online Brazilian community (orkut- Brasileiros na Nova Zelandia) and is just appalling what this couple is trying to do Mr Moura goes online every single day on the Online Community to say how unhappy he is with New Zealand that all of us, Brazilian citizens, who are here in New Zealand are losers and are only here because we lived in the slums in Brazil. When anyone in the community tries to argue with him saying that no we are here, including myself, because we love this country, our jobs and are happy. Due to the lack of arguments he starts to use foul language and disrespect all members who participate in the topic. Mr Moura does NOT deserve to have received an exception of the policy and had a visa granted, simply because he hates New Zealand. He repeats that over and over and over again on the online community. It is just sad that he is doing all this and now a lot of people will have the wrong perception about Brazilian citizens who live here in New Zealand. On the other article it was said that Mr Moura had received from a lovely kiwi lady some clothes to help them. Mr Moura strongly denied this on the online community saying that nobody ever helped himself or his family. Another point that Mr Moura forgets to mention on his interview is that although he allegedly has no money to cover his expenses his profile picture on the online community shows a BMW. Maybe Mr Moura could sell his car and buy a flight back to Brazil. I have to use the same words as John Go Home (Vai Embora) one thing is for sure he could definitely get a job as a politician once he is back home as I have yet to meet someone who is more “poker face” than Mr Moura. Please enough with the media coverage for this family, everybody deserves to be happy and they are clearly not happy here. So, let them go.
Helen, You are mistaken. There is no indication that this couple did anything wrong except have a baby, which is not a crime unless you are an immigrant. To make a pregnancy a crime is total communism. This country is moving from socialism to communism and you are blind to the facts. If people do not speak up now, in a few years it will be a crime for New Zealanders to have babies without government approval. See China about that new legislation.
I just cannot believe Mr Moura has the guts to go public after all the bad things he said about New Zealand.

There are as many deserving cases of overseas people wanting to secure residency and the right to work. The vast majority get on with it, plan better and follow the rules. This couple have whinged and moaned and tried to get special treatment. Now they are getting special treatment (which I ansolutely do not agree with) and they are still not happy.
No, it's not a reprieve, this is just because the media got hold of the story. Once the public has lost interest this family will be kicked out whether Marcio's employer can find another craftsman or not.
There are good rules in place to protect NZ against paying for people to have babies, rules which have nothing to do with this family who would contribute to NZ for the rest of their lives and have already paid taxes for three years.
I salute them. They have shown real grit in standing up to bureaucracy which was pressuring them to kill their unborn child. Now they are losing everything they have worked years for simply because of an accidental pregnancy they refused to 'get rid of'.
Kicking valued and skilled people out is not in New Zealand's best interests. This has been confirmed on a similar case by the independant Removals Review Authority board.
Careful migration management under the current quotas is a guaranteed source of billions of dollars in income and guaranteed job creation without displacing any kiwi workers. Hearing about stories like this however globally mobile workers will chose other countries like Australia to enrich as NZ is no longer 'migrant-friendly'.

All I would say is ....Its all part of their Drama......I know these couple well... I have seen the Orkut communuty site as well...If the Immigration or any common Kiwi sees that .,,,They would definitely tell them to leave NZ,,and live back in their own country.. I still cant understand why they are sticking here.,...He is doing subletting business ....He has a posh BMW ....which if he sells he can fly twice with his family......
