Pair's assault 'blots good record'

Court
Previous good character and no criminal history were taken into account at the sentencing in the Invercargill District Court yesterday of two men for an assault and burglary.
David Brian Casey, 20, sheet-metal worker, and Dylan James Sherriff, 19, dairy worker, of Otahuti, appeared before Judge Dominic Flatley for sentence, jointly charged with assaulting Anthony Sloane with intent to injure him and entering his Ryal Bush home with intent to commit a crime on November 26.
Lawyers for the pair, John Fraser for Casey and Richard Smith for Sherriff, told Judge Flatley of their respective clients' good character, while Mr Fraser said his client was not the lead offender in the incident, which he said had been sparked by a series of text messages from Mr Sloane.
Judge Flatley said he intended to treat both men as equally culpable.
"What you did here was very, very bad." He told the pair they had blotted their previously unblemished records and their convictions would follow them for the rest of their lives.
The charges were serious and represented the magnitude of the offending, he said before sentencing them to 350 hours' community work on each charge, to be completed concurrently.
He also made an order for reparation to be paid to Mr Sloane.
Breach
Jail was inevitable, Judge Flatley told a patched Mongrel Mob member for breaching release conditions yesterday.
Selwyn Herewini Waimoana, 35, appeared charged with breaching his release conditions from jail on December 16 and on March 2 and 3. He was convicted and remanded to reappear in the Invercargill District Court on June 11.
Michael Joseph Wahia, 19, was convicted and issued a final warning for breaching his community work sentence on February 12.
Sharon Emma Ah-Chong, 17, was convicted and discharged for breaching community work on February 4.
Nikki Renee Shields, 24, was sentenced to 14 days' jails for breaching community work on December 12.
Brooke Shay Dawson, 21, was sentenced to a further week's home detention for breaching her sentence by drinking alcohol on March 11.
Cody-Lee Cresswell, 20, was sentenced to one month's jail concurrently on each of three charges of breaching community work on October 9, December 1 and March 6.
Assault
Jared James Breen, 20, was convicted and remanded to June 11 for assaulting his former partner with intent to injure her on February 26.
Stealing
Sean Roger Phillips, 17, dairy worker, of Winton, was disqualified from driving for eight months and sentenced to 75 hours' community work each for driving in a manner that caused his vehicle to undergo sustained loss of traction on December 16, stealing petrol valued at $100 and dangerous driving on January 26 and stealing petrol valued at $101.70 on January 28.
Matthew William Gray, 20, barman, was remanded to March 24 for sentence alongside other charges for stealing five Xbox games valued at $480, the property of Jessie Stephen Currie.
Desaray Sierra Nelson, 23, was sentenced to 350 hours' community work and six months' supervision on seven charges of shoplifting between May and November.
Driving
Michael Robert Doyle, 49, tiler, was fined $500 and disqualified from driving for six months for dangerous driving near Winton on December 12.
Darren Gordon Kevin Cavanagh, 19, was sentenced to 40 hours' community work and disqualified for six months for operating a car in a race on February 18.
Nicholas Simon Dykes, 19, painter, was fined $500 and disqualified for six months for driving in a manner that caused his vehicle to undergo sustained loss of traction on December 23.
Nathan Peter Hussey, 20, dairy worker, of Twinlaw, was sentenced to 200 hours' community work cumulative on his current sentence and disqualified for a further eight months to February 4 for driving while disqualified on February 25.
Harley David McKenzie, 20, meatworker, of Tuatapere, was sentenced to a total of 70 hours' community work for driving dangerously and intentionallydamaging road signs on July 18. He was also disqualified for six months.
Joshua David Spence, 19, engineer, was fined $600 and disqualified for six months for driving while disqualified on February 23.
Luke James Hay, 18, painter, was sentenced to 40 hours' community work and disqualified for six months for driving while suspended on on February 20.
Shane Antony Manuel, 18, was sentenced to 40 hours' community work and disqualified for six months for driving while suspended on February 15.
Drink-driving
Daniel Paul Officer, 31, concrete worker, was sentenced to 80 hours' community work and disqualified from driving for 10 months for driving with a breath alcohol level of 830mcg on February 28.
Ryan Alexander Popham, 20, 691mcg on March 7. Fined $600 and disqualified for six months.
William Hector Ayers, 23, labourer, of Halfmoon Bay, was sentenced to a total of 100 hours' community work for driving with a breath alcohol level of 700mcg and possessing cannabis at Invercargill on March 4. He was also disqualified for six months.
Sarah Louise Price, 19, labourer, was sentenced to 150 hours' community work, to be completed concurrently, for driving with a breath alcohol level of 506mcg on February 28 and driving while suspended on March 16. She was also disqualified for 12 months.
Romaine Rongopai Emma Bright, 25, 599mcg on February 21. Fined $850 and disqualified for eight months.
Anthony Allister Buchanan, 20, apprentice mechanic, of Otapiri, 707mcg on March 14. Fined $760 and disqualified for six months.
Lynley Anne Cross, 51, 858mcg on March 7. Disqualified for eight months and sentenced to six months' supervision and ordered to complete 40 hours' community work.
Anthony Karl Hutley, 40, unemployed, 999mcg, having been convicted of drink-driving at least twice previously. Sentenced to 200 hours' community work, 12 months' supervision and disqualified for 14 months.
