One of two 18-year-olds charged with the rape of a 17-year-old teenager at an Oakura party last year was jailed by police after breaching his High Court bail conditions.
The two, former New Plymouth Boys' High students, have been given name suppression prior to trial in the High Court in New Plymouth in November.
The case has been compared to that of the Roastbusters after a video of the alleged sexual activity between the two males and female was posted on line.
In the New Plymouth District Court on Thursday the teenager's lawyer Paul Keegan said his client was a severe diabetic and spent an uncomfortable night in police custody. He had simply forgotten to report to police on Monday as required to do every week.
He has no previous convictions, Keegan said.
Judge Allan Roberts convicted and discharged the teenager, warning him that if he re-offended in future the breach would have to go before the High Court.
