Supervision after indecent act

A Hawera man who performed an indecent act in front of a woman and her child has been sentenced to supervision.

Yesterday, Bernard John Cartwright, 38, beneficiary, was sentenced in the Hawera District Court on charges of performing an indecent act and theft.

He had previously pleaded guilty to the charges, which relate to offending between August last year and January this year.

During that time, Cartwright stole about $50 worth of underwear and then on January 19 he was caught masturbating by a woman who at the time was watching her 18-month-old son playing outside.

Cartwright left the scene as soon as he was spotted by the woman.

Judge Allan Roberts said a mental health assessment report suggested Cartwright would benefit from support and psychological treatment for his offending behaviour, which included a previous similar conviction in 2002.


Judge Roberts said since the offending Cartwright had moved in with his brother.

"At least in that environment you have some oversight and support," the judge said.

Judge Roberts sentenced Cartwright to nine months of supervision. There were special conditions and Cartwright had to complete counselling to reduce his risk of reoffending.

A final warning was also placed on Cartwright's court file.

"This has got to end," the judge said.
