A drink-driver was warned he could have ended up in prison after he injured a young woman whose father had been killed by a drink-driver.
Ricky Shayne O'Connell, 20, of Temuka was sentenced in the Timaru District Court on one charge of drink- driving causing injury. His level was 187mg.
The court heard that on June 15 this year O'Connell was driving a vehicle and pulled out on to State Highway 1. He tried to overtake another vehicle, lost control and collided with the car he was overtaking. Both left the road.
O'Connell's vehicle rolled 30 metres, throwing the back-seat passenger out of the rear window.
The car came to rest upside-down, trapping the occupants. The other car hit a power pole.
All seven occupants were taken to hospital.
A female occupant suffered the worst injuries and spent three days in hospital with two hip fractures and scarring to her chin that is likely to be permanent. She had also recently lost her father, killed by a drunk driver.
Judge Raoul Neave commended O'Connell for attending restorative justice with the victim and her family. However, he warned him prison could easily have been the outcome.
"A sentence of imprisonment would have been justified; it could have been a starting point of 15 months. I will give credit for your lack of previous offending and credit for restorative justice and offering reparation and you pleaded guilty at the first opportunity."
He was sentenced to three months' home detention, to pay $140 reparation and $1500 for emotional harm, and disqualified from driving for six months.
