Taxi driver accused of rape says sex was consensual

A taxi driver accused of raping a female passenger says the woman would have bitten his penis off if the encounter wasn't consensual.

Keyse Awil Abdi took the stand in the Hamilton District Court yesterday to give his version of what happened between himself and the complainant on June 14, 2013.

In doing so he exposed himself to cross examination by the Crown prosecutor on day three of the jury trial.

Abdi has pleaded not guilty, through a Somali translator, to one charge of rape, two of unlawful sexual connection and a further charge of burglary.

The accused was defence counsel Russell Boot's sole witness.

The 29-year-old woman had earlier testified that Abdi dropped her home after a night on the town then crept up behind her and pushed her over before dragging her into the lounge. There she said Abdi forced her to perform oral sex before raping her. 

She said she struggled and tried to push him off before giving up and laying on the lounge floor.

Abdi said that if the woman was struggling and fighting then she would have bitten his penis off.

Speaking Somali, Abdi described how he picked a man and a woman up in central Hamilton on a busy Thursday night. She sat behind him and he was beside her. Halfway to the woman's house the man got out without a word, Abdi said.

"I asked, who's going to pay? She said, 'I will pay for the fare'."

They talked on the way to her house, Abdi said.

Driver and passenger exchanged names, he said, before she asked if Abdi had a girlfriend.

"I said no and asked if she had a boyfriend. She said no."

At the woman's house Abdi said he parked on the roadside.

"Then we talked about whether we could have some fun together. I also asked whether she lived with other people in the house. She said no." 

After lunch, Abdi returned to that moment and told the court he forgot to mention they also agreed for him to pay for sex.

He said the pair exchanged a high five before she asked him to park in the driveway. He stopped the meter. She didn't pay. And she asked him to get out, Abdi said.

The woman used keys to open the door before turning the light on, he said.

"When I went in, there was a kitten and a dog there and they sort of walked towards me." Abdi's religion prohibits touching the latter and he asked her to get it away, which she did, he said.

She then hung the keys on a hook.

They walked to the lounge where they sat on the couch and started kissing. The court heard that she went to the toilet and when she got back the kissing continued. Abdi said the woman then performed oral sex on him.

"Yesterday she said she was trying to fight with me. If there was a fight happening she would have bitten my penis off".

He did not force her, Abdi said. The court heard the pair then had sex on the floor.

Abdi said he gave the woman a $5, $10 and $100 note. The woman then walked him out and kissed him again, he said.

During cross examination, Crown prosecutor Jamie O'Sullivan said his story was a fiction.
