A retired policeman who was planning to fight a charge of speeding in Hamilton City Council's new 40 kilometre per hour speed limit area in Dinsdale has had the charge withdrawn by police.
But Denis James Corcoran, 87, didn't win the case on principle.
In the Hamilton District Court this morning, prosecutor Sergeant Andrea McBeth said the witnesses were unavailable for the defended hearing and ''in the interests of justice'' withdrew the charge.
Corcoran was driving on Dinsdale Rd on June 5 when he was clocked by a speed camera doing 53kmh after the recently installed 40kmh safer speed limit zone was in force - something of which he was unaware.
Hamilton city council lowered the speed limit in March, however, residents noticed signs only at either end of Dinsdale Rd.
Residents coming out of feeder or side streets initially had no idea the limit had suddenly changed.
Ms McBeth said the penalty for a charge of exceeding the speed limit was only a minor fine and it wasn't worth the court's time and just cause further delays.
Community Magistrate Susan Hovell withdrew the charge, but then Corcoran said the case had caused him a lot of stress and money and he wanted to file for costs.
He had driven that road for 13 years without incident and to get ticketed for going 53kmh was a kick in the guts.
''Dinsdale Rd should never have had the 40kmh speed limit imposed on it because it's one of six arterial routes.''
However, Corcoran's request was declined by Mrs Hovell as the threshold for costs was quite high.
''I understand how you feel but it's not the police who impose the 40kmh speed limits and there's several around Hamilton ... but they are imposed by council. The police are there to make sure people don't break the speed limit.''
Outside court, Corcoran was pleased with the result and said he'd spoken with Mayor Julie Hardaker who'd assured him - if she was re-elected - she'd make sure the speed limit on Dinsdale Rd would be revoked.
''She got my vote,'' he said.
